**ARTICLE 1 – Object**

These sales conditions are entered into, on one hand, by Mrs. Amandine REVEL NEWMAN, a sole proprietor established in THYEZ (74300), specializing in the field of teaching sports disciplines and leisure activities as the main activity and as a Web Graphic Designer and sale of printed products in THYEZ (74300) as a secondary activity, registered under SIRET number 45204694900023, hereinafter referred to as “CosyNEVE,” and on the other hand, by any natural person, consumer visiting and/or wishing to make a purchase via the website www.cosyneve.com, hereinafter referred to as “The client.”

These sales conditions aim to define the terms and conditions of distance selling between CosyNEVE and the client, from ordering to services, including payment and delivery. They regulate all the necessary steps for placing an order and ensure the follow-up of this order between the contracting parties on the website www.cosyneve.com.

Any buyer on the www.cosyneve.com website is deemed to have read and accepted in full the general terms and conditions of sale below before confirming their order.

These sales conditions will prevail over any other general or specific conditions not expressly agreed upon by CosyNEVE.

CosyNEVE reserves the right to adapt or modify these general terms and conditions of sale at any time for legitimate reasons. In the event of a modification, the general terms and conditions of sale in force on the www.cosyneve.com website on the date of the client’s order will apply. If a condition is lacking, it will be considered governed by the customs prevailing in the distance selling sector whose companies have their registered office in France.

**ARTICLE 2 – Description**

www.cosyneve.com is a website designed to offer illustrations for sale printed on paper and/or fabric.

The products offered for sale by CosyNEVE are those listed on the www.cosyneve.com website on the day the client visits the site. All product offers and delivery terms are valid in metropolitan France and worldwide, subject to availability. In the event of unavailability of the product after placing the order, CosyNEVE undertakes to inform the client.

**ARTICLE 3 – Order**

The client can place an order with CosyNEVE on the www.cosyneve.com website 24/7.

The client can at any time inquire about the status of their order by sending an email to amandine@cosyneve.com.

CosyNEVE reserves the right to refuse any order from a client with whom there is a dispute regarding the payment of a previous order until this dispute is resolved, an incorrect address, or other issues with the client’s account.

– Order Steps:

The client must:

• select the products and add them to the cart.

• indicate the quantities requested.

• select the delivery location and method.

• make the payment on the secure Paypal interface or by bank transfer, which will formalize the sales contract between the client and CosyNEVE.

An email is automatically sent to the client to confirm the order, provided that the email address provided in the registration form is correct.

The client must verify the completeness and accuracy of the information provided to CosyNEVE. The delivery address is the address provided by the client. CosyNEVE cannot be held responsible for any typing errors and their consequences in terms of delay or delivery error. In this context, all costs incurred for reshipment will be borne by the client.

**ARTICLE 4 – Rates**

The prices listed on the product sheets are in Euros, including all taxes, and do not include order processing, shipping, and delivery fees.

They take into account the applicable VAT on the day of the order. Any change in the rate may be reflected in the prices of products and items, without prior notice to the client.

CosyNEVE reserves the right to change its prices but undertakes to apply the rates indicated to the client at the time of registration of their order.

**ARTICLE 5 – Payment**

Payments are made online via PayPal, in which case the terms of use of PayPal apply. Payments are also possible by bank transfer, and the order is confirmed upon receipt and visibility of payments in the CosyNEVE bank account.

The date of order validation corresponds to the payment date.

The products remain the property of the www.cosyneve.com website until the full payment of the price.

Fraud Prevention Measures

CosyNEVE has the freedom to verify the personal data provided by the client and to take necessary measures (request for documents or order cancellation) to ensure that the person whose bank account is debited is the one who placed the order and to prevent any fraudulent use of credit card numbers.

**ARTICLE 6 – Shipping Costs and Delivery**

Deliveries are possible worldwide. Products are delivered to the delivery address provided during the order process. Several delivery methods are offered by Mondial Relay or La Poste. You are invited to choose one when placing the order, before proceeding to payment.

Orders are processed and shipped within 10 working days after receiving payment.

The delivery time depends on the chosen mode of delivery specified during the order process.

In case of a delay in delivery of more than 3 days, we recommend contacting your Post Office or Mondial Relay to ensure that your package is not pending. If necessary, report this delay to us by email.

CosyNEVE cannot be held responsible for delivering a package to an incorrect address if this error results from the information provided by the client when placing the order. Similarly, if the inability to deliver the package to the client results from their actions, the client will be refunded the amount of the order, minus the processing and shipping costs for the round trip.

**ARTICLE 7 – Right of Withdrawal**

In the context of distance selling (without the simultaneous physical presence of the parties), the client has, in accordance with Article L 121-20 of the French Consumer Code, a withdrawal period of seven days from the delivery of their order to return the product to the seller for exchange or refund without penalty within 30 days, excluding return and initial shipping fees.

The article must be returned according to a procedure provided upon request to amandine@cosyneve.com.

Returned items must be in new condition and in their original packaging to enable their subsequent commercialization. Any item not meeting these characteristics will not be refunded or exchanged.

Return costs are borne by the buyer. In case of loss or damage to the returned package, we cannot refund the order, and the buyer must file a claim directly with their carrier.

**ARTICLE 8 – Transfer of Ownership / Transfer of Risks**

The transfer of ownership of the items to the benefit of the client is realized on the day of full payment of the price, regardless of the delivery date of the items.

The transfer of the risks of loss or deterioration of the items occurs upon delivery and receipt of the items by the client.

**ARTICLE 9 – Guarantees**

All products offered for sale on the www.cosyneve.com website benefit from the legal warranty of conformity (L211-1 and following of the Consumer Code) and the warranty against hidden defects (articles 1641 and following of the Civil Code), allowing the client to return defective or non-compliant products.

Except in the case of legal warranty, CosyNEVE undertakes to refund the client or exchange any product that is apparently defective, damaged, or damaged within 1 month from the date of receipt
